The cost of a trademark registration in Poland depends on what goods or services the trademark is intended for and if one wants to register the trademark in Poland only, or in the entire European Union.
Companies offering their goods and/or services in Poland often decide to register their trademarks with the Polish Patent Office. The protection of trademarks registered with the PPO is valid in Poland only.
Therefore, it is worth considering registering the trademark with the European Union Intellectual Property Office (EUIPO) – in order to have a trademark registration which extends to all 27 EU member countries, including Poland.
Although trademark applications can be submitted independently, it is advisable to entrust this process to a professional – a Polish patent attorney, who is always simultaneously a trademark and design attorney.
A patent attorney will advise on whether it is better to register a word mark or a logo and if it is reccomended to file it to the PPO or EUIPO – or maybe to both? A Polish patent attorney will prepare, in accordance with the Nice classification, a list of goods and services that will allow for the best protection of the trademark. The number of Nice classes affects the cost of a trademark registration in Poland and in the EU.
Moreover, a Polish patent attorney can also assist their clients with registrating a trademark in other countries worldwide.
The cost of registering a trademark with the Polish Patent Office for one Applicant is as follows:
If the application process for the trademark proceeds completely smoothly, publication fees for the registration and the first 10 years of protection are payable approximately 6 months after the trademark application date.
An additional cost is the patent attorney’s fee.
The official fee for a power of attorney is 17 PLN.
Registering a brand or logo in 27 EU countries by submitting a trademark application to the EUIPO involves the following costs:
The official fee covers both the trademark application, its registration, and the first 10 years of protection. It is not divided into two stages (as in the Polish Patent Office). However, if the EUIPO refuses to register the trademark, the fee paid is completely non-refundable.
The patent attorney’s fee for processing the trademark application to EUIPO is an additional cost.
